{"id":8113,"date":"2021-01-18T21:08:01","date_gmt":"2021-01-18T17:08:01","guid":{"rendered":"https:\/\/lawblog.az\/?p=8113"},"modified":"2021-01-18T21:08:01","modified_gmt":"2021-01-18T17:08:01","slug":"azerbaijan-files-lawsuit-against-armenia-after-end-of-the-2020-karabakh-war","status":"publish","type":"post","link":"https:\/\/lawblog.az\/en\/blog\/2021\/01\/18\/azerbaijan-files-lawsuit-against-armenia-after-end-of-the-2020-karabakh-war\/","title":{"rendered":"Azerbaijan files lawsuit against Armenia after end of the 2020 Karabakh War"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">On January 15, 2020, Azerbaijan submitted an application to the European Court of Human Rights against Armenia, Azerbaijani state news agency<\/span><a href=\"https:\/\/azertag.az\/en\/xeber\/1689905\"> <span style=\"font-weight: 400;\">reports<\/span><\/a><span style=\"font-weight: 400;\">. The application addresses \u201crights and freedoms of Azerbaijani citizens affected by Armenia\u2019s military aggression against Azerbaijan\u201d. This adds up another case to the<\/span><a href=\"https:\/\/www.echr.coe.int\/Documents\/InterState_applications_ENG.pdf\"> <span style=\"font-weight: 400;\">list of interstate cases<\/span><\/a><span style=\"font-weight: 400;\"> in the ECHR, which<\/span><a href=\"https:\/\/www.ejiltalk.org\/inter-state-applications-under-the-european-convention-on-human-rights-strengths-and-challenges\/\"> <span style=\"font-weight: 400;\">began to rise considerably<\/span><\/a><span style=\"font-weight: 400;\"> in recent years.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cThe application raises the issue of violation of the right to life, respect for personal and family life, freedom of religion, torture and ill-treatment, violation of the right to property and movement of citizens of the Republic of Azerbaijan as a result of the occupation of Nagorno-Karabakh and seven surrounding districts on the part of Armenia for nearly 30 years. There is also evidence that 3,890 Azerbaijani citizens went missing and Armenia has not taken any action to investigate the fate of these individuals.\u201d<\/span><\/p>\n<p>&#8211; <em><a href=\"https:\/\/azertag.az\/en\/xeber\/1689905\">Azertag<\/a><\/em><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Azerbaijan<\/span><a href=\"https:\/\/mfa.gov.az\/en\/news\/6893\/view\"> <span style=\"font-weight: 400;\">invoked the right to self-defence on September 27, 2020<\/span><\/a><span style=\"font-weight: 400;\"> concerning<\/span><a href=\"https:\/\/www.ejiltalk.org\/the-recent-ceasefire-in-nagorno-karabakh-territorial-control-peacekeepers-and-unanswered-question-of-status\/\"> <span style=\"font-weight: 400;\">its internationally recognized<\/span><\/a><span style=\"font-weight: 400;\"> but occupied territories, a full-scale war of 44 days ended with a trilateral <\/span><a href=\"http:\/\/en.kremlin.ru\/acts\/news\/64384\"><span style=\"font-weight: 400;\">ceasefire agreement<\/span><\/a><span style=\"font-weight: 400;\"> of Armenian, Azerbaijani and Russian leaders. Russian peacekeepers would be deployed in part of Nagorno Karabakh (where ethnic Armenians live) along with the withdrawal of Armenian forces, as agreed by article 4 of the agreement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The UN Security Council asked Armenia four (Resolutions<\/span><a href=\"https:\/\/undocs.org\/S\/RES\/822(1993)\"> <span style=\"font-weight: 400;\">822<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/undocs.org\/S\/RES\/853(1993)\"> <span style=\"font-weight: 400;\">853<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/undocs.org\/S\/RES\/874(1993)\"> <span style=\"font-weight: 400;\">874<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/undocs.org\/S\/RES\/884(1993)\"> <span style=\"font-weight: 400;\">884<\/span><\/a><span style=\"font-weight: 400;\">) times to withdraw its forces from occupied territories of Azerbaijan \u2013 Nagorno Karabakh and seven adjacent districts back in 1993. However, the occupation did not end until the 2020 Karabakh War while peace talks failed.<\/span><\/p>\n<p><a href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/Housing\/Azerbaijan.pdf\"><span style=\"font-weight: 400;\">700,000 Azerbaijanis were internally displaced<\/span><\/a><span style=\"font-weight: 400;\"> from Karabakh back in the early 1990s as the result of hostilities. Although Armenian occupation ended, houses and buildings in previously occupied territories are<\/span><a href=\"https:\/\/www.economist.com\/europe\/2020\/12\/16\/azeris-return-to-their-ruined-old-homes\"> <span style=\"font-weight: 400;\">practically non-habitable<\/span><\/a><span style=\"font-weight: 400;\"> since<\/span><a href=\"https:\/\/www.nytimes.com\/2001\/05\/27\/world\/trying-to-tell-a-truce-from-a-war.html\"> <span style=\"font-weight: 400;\">settlements were destroyed<\/span><\/a><span style=\"font-weight: 400;\"> throughout the last 30 years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although there was an unrecognized government in the occupied territories, in<\/span> <a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-155353\"><i><span style=\"font-weight: 400;\">Chiragov and others v. Armenia<\/span><\/i><\/a><span style=\"font-weight: 400;\"> (para. 186), the ECHR found Armenia having effective control in the occupied territories. Additionally, it is solely Armenia that took the obligation of withdrawing forces from Karabakh in the<\/span><a href=\"http:\/\/en.kremlin.ru\/acts\/news\/64384\"> <span style=\"font-weight: 400;\">latest ceasefire deal<\/span><\/a><span style=\"font-weight: 400;\">. However, Armenia can be expected to contest its responsibility for violations alleged in the application.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case is worth watching in the light of ECHR\u2019s latest<\/span><a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-207622\"> <span style=\"font-weight: 400;\">decision on Ukraine v. Russian Federation (VII)<\/span><\/a><span style=\"font-weight: 400;\">, which declared Ukraine\u2019s certain complaints against Russia admissible.
